NBFC’s Loans: Legal Guidelines & RBI Rules You Must Know

India’s digital lending market has been growing quite fast over the last few years. From salaried employees to small business owners, millions of Indians are now taking an NBFC loan through mobile apps. NBFCs have now become the leading provider of personal loans, business loans and instant credit facilities. But with the rise of digital lending, the number of fraudulent apps and illegal recovery practices has also increased.

What is an NBFC?

NBFC, which stands for Non-Banking Financial Institution, is a financial institution that offers a variety of banking services. It doesn’t hold any banking license but is registered under the RBI. NBFCs are majorly involved in lending, investing in securities, asset financing, lease and offering loans.

They provide a variety of loans, like personal loans, business loans, gold loans, vehicle loans, etc. However, NBFCs differ from banks. They cannot demand deposits like banks. However, they still play a big role in providing credit to individuals and businesses.

RBI Guidelines for NBFC Loans

To protect borrowers, the RBI has issued certain rules related to digital lending and NBFC operations. They are as follows: –

1. RBI Registration is Mandatory

All NBFCs offering loans in India must be registered with the RBI. Illegal loan apps portray themselves to be financial companies, but without proper authorisation. The RBI now has a public directory of digital lending apps which are associated with regulated entities like banks and NBFCs.

Before taking a loan, the borrower shall check whether the lending app is linked with an RBI-registered institution or not.

This is why borrowers are advised to choose only RBI-approved loan apps connected with regulated lenders.

2. Mandatory Key Fact Statement

The borrower must be provided a Key Fact Statement (KFS) before a loan is given. The KFS must include interest rates, processing charges, late payment fees, foreclosure charges, loan tenure, EMI details, etc. The lender cannot impose any hidden charges later on without the borrower’s consent. Due to this, borrowers can understand the actual cost of an NBFC loan before signing the agreement.

3. Direct Loan Disbursement

As per RBI rules, the loan amount has to be transferred directly to the borrower’s bank account. Disbursal through third-party accounts is not allowed anymore. This rule increases transparency and reduces the risk of fraud in digital lending transactions.

4. Borrower Data Protection

The misuse of personal data by fake loan apps is a big concern for borrowers. Some apps have also, in past, illegally accessed contacts, photos, and private files to harass borrowers during recovery.

  • As per RBI guidelines, now they require: –
  • Explicit borrower consent for data access.
  • Limited permissions on mobile devices.
  • Secure storage of borrower data.
  • No unnecessary access to contacts or galleries.  

5. Fair Recovery Practices

NFBCs and recovery agents have to follow ethical recovery methods. Harassment, threats, public humiliation or contacting unrelated individuals are against the RBI norms.

However, if borrowers face any harassment from lenders, then they can file complaints through: –

  • NBFC grievance officer
  • RBI Ombudsman
  • Cybercrime portal
  • Local police authorities

6. Disclosure of Actual Lender

Many digital lending apps act only as intermediaries while the actual loan is provided by the NBFC or bank.

Under RBI guidelines: –

  • The actual lender’s name has to be clearly displayed.
  • The loan agreement must mention the regulated entity.
  • Borrowers should know who is providing the loan.  

How to Verify a Loan from a Registered NBFC?

Before taking any loan, do go through this safety check: –

  • Go to the official website of the RBI and verify if the NBFC is registered or not.
  • The app or website should clearly mention the name of the lending NBFC and not just the brand name.
  • RBI-approved loan apps don’t ask for access to your contacts, gallery or file manager. If an app is asking for unnecessary app permissions, then it’s a red flag.
  • Go through the loan terms carefully. It shall have clear information about interest rates, processing fees, late payment penalties and hidden fees.

NBFC loans have made borrowing faster and more accessible to millions of Indians through digital lending platforms. However, borrowers must be very cautious while choosing lenders and loan apps. RBI guidelines are designed to improve transparency, protect borrower data and ensure fair lending practices.

Before opting for a loan, you shall verify whether the lender is registered with the RBI, read the KFS document and avoid apps asking for unnecessary permission. Choosing RBI-approved loan apps and loans from registered NBFCs can help you stay away from fraud, hidden charges and harassment.
